ASPPlayground.NET License Agreement

By purchasing the ASPPlayground.NET SQL Forum Software License ("The Product"), the License Holder ("you") agree to the following terms and conditions stated by ASPPlayground.NET ("we", "us"):

1. An ASPPlayground.NET SQL license grants you the right to run one instance of The Product on one web server and one web site for each license purchased. Each license may power one instance of The Product on one web site.
   
   For each installed instance of The Product, a separate license is required.
   
   "One instance" is defined as the following:
   
   
   1. Database (tables & stored procedures):
      one set of the tables and store procedures defined in our sql script exist on a single database; in other words, once you run our full installation script once, it is considered one instance of the database.
      
      
   2. Web (ASP / ASPX / JS / VB ) files:
      one set of the Web files contained in the package exists on a single web directory. In other words, once you upload the files onto a single directory, it is considered one instance of the Web files.
      
      
   3. 1. and/or 2. that is accessible from one single base URL is considered one instance.
      
      
   4. Clustered Environment / Web Farm: A license is required for each web server on your Web Farm as there is a set of web files on each web server.
      
      
   5. Development Server: if you are required to maintain a development environment in addition to the production environment at the same time, you are permitted to have one instance per license you own, as defined above, installed on you development server for development purposes only.
      
      
2. All ASPPlayground.NET OEM license holders who purchased a bulk license of 20 branded or unbranded copies have the right to install 20 instances of The Product on a maximum of 20 web sites (20 separated URL's).

   ASPPlayground.NET will offer support services stated here for your clients, and you will be required to register each instance that you install for your clients regardless of the type of license (branded or un-branded) you purchase.

   If you purchase the un-branded license, we will not make direct contact with your clients, and you will be responsible to answer all the questions or inquiries from your clients. However, you are still eligible to obtain support services from us directly, which includes private forum access plus free e-mail support.

3. We will not offer support nor updates to sites/persons that purchase wrong license, for example, a personal license for use on a commercial site. However, we do offer an upgrade program with which you can upgrade your license to a sufficient one.
   
   
4. You must submit the URL where you are using (or plan to use) each license. The URL can be submitted via the ASPPlayground.NET member's area (http://www.aspplayground.net/forum).
   
   
5. The Product's source code may be altered (at your owner risk), but The Product (altered or otherwise) may not be distributed to entities beyond the license holder without the explicit written permission of ASPPlayground.NET.
   
   
6. All ASPPlayground.NET SQL copyright notices must remain unchanged and visible UNLESS you obtain an un-branded license first from us.
   
   
7. The Product's Commercial License can be purchased for your client as a stand-alone application. Stand-alone application means that The Product is used as is, without modification of any kind to the source code, without repackaging of any kind, and is installed one instance per license purchased for your client. If you bundle The Product with other software or services with any modification to the The Product's source code as part of your business offering, you will need to obtain the un-branded license.
   
   
8. The Product may not be used for anything that would represent or is associated with an Intellectual Property Violation, including, but not limited to, engaging in any activity that infringes or misappropriates the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, software piracy, and patents held by individuals, corporations, or other entities.
   
   
9. ASPPlayground.NET will be the only installation service provider in the event that you are not able to install The Product on your own. If The Product is installed by a third party contractor, ASPPlayground.NET will void your right to obtain support regarding installation. ASPPlayground.NET will not be held responsible if you cannot install the software yourself.
   
   
10. When you purchase or download The Product, it is considered to be "Opened". Opened software cannot be returned for refund, regardless of the delivery method. ASPPlayground.NET does not accept any returns nor make any refunds for The Product. Please be sure your server meets our software requirements before purchasing, as we will not refund purchases on our open source software due to system compatibility problems. However, You may still return The Product and receive a refund if all of the following apply:
    
    
    1. You have verified that your Web Server and SQL Server meets The Product's system requirements; and
       
       
    2. We have been unable to install The Product on your server in accordance with a service agreement between You and ASPPlayground.NET (the professional installation service); and
       
       
    3. the request for a refund has been made within 7 days of your purchase. Your refusal to permit us to install The Product will void your right to a refund.
       
       
11. If any terms are violated, we reserve the right to revoke your license at any time. No license refunds will be granted for revoked licenses.
    
    
12. We reserve the right to modify these terms at any time.
    
    
13. The Product is protected by copyright and other intellectual property laws and treaties. The Product is licensed, not sold.

Disclaimer of Warranty

THIS PRODUCT AND THE ACCOMPANYING FILES ARE LICENSED "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED.

ASPPlayground.NET is not liable for the content of any message posted on a forum powered by The Product.

You must assume the entire risk of using The Product. ANY LIABILITY OF ASPPLAYGROUND.NET WILL BE LIMITED EXCLUSIVELY TO PRODUCT REPLACEMENT.

ASPPlayground.NET may inspect your registration integrity. The only information required from you are:

• Your Proof of purchase (Order ID or Invoice). Your Order ID is printed on your order notification e-mail from ShareIt.com.
  
  
• The URL which the forum is run on.

Should we discover discrepancies in the software usage, be aware that you may lose your license and may face legal actions for Software Piracy.
